Alpha Modus receives 13th U.S. patent for in-store retail media tech

September 3, 2026 8:58 AM EDT

Alpha Modus Holdings, Inc. (NASDAQ: AMOD) announced that the U.S. Patent and Trademark Office has issued U.S. Patent No. 12,725,176 to its subsidiary, Alpha Modus, Corp., covering a method for converting in-store shopper behavior into personalized offers delivered to a shopper's mobile device.

The patent, titled "Method for Personalized Marketing and Advertising of Retail Products," is the company's 13th granted U.S. patent. Its priority chain traces back to a provisional application filed in July 2013.

The patent describes a two-system method. One system monitors shopper activity at the shelf — including position tracking, eye movement, or direct interaction with a kiosk, display, tablet, or phone — and builds an analysis incorporating demographic and sentiment data. A second system determines the shopper's location and delivers a personalized offer to a mobile device, kiosk, or sales associate. The offer can include pricing, in-store product placement, advertising content, digital or printed coupons, limited-time price reductions, alternative store locations with prices, and routing for shipping or in-store pickup.

CEO William Alessi said: "Retail media spent a decade learning how to talk to shoppers online. The hard part was always the store. This patent covers the handoff: behavior at the shelf on one side, a priced offer in the shopper's hand on the other. We filed on that idea in 2013, and our prior art dates back to that."

Alpha Modus now holds 13 granted U.S. patents with one application pending, covering areas including real-time consumer behavior analysis, personalized in-store marketing, shelf intelligence, inventory management, and customer assistance. The most recent prior patent in the same family, U.S. Patent No. 12,591,901, was granted on March 31, 2026.

The company also previously defeated a motion to dismiss brought by MNTN in August 2026, according to the press release.
