Court overturns $22.7M damages award against Gogo in SmartSky case

A U.S. District Court in Delaware overturned a $22.7 million jury damages award against Gogo Inc. (NASDAQ: GOGO) in a patent lawsuit brought by SmartSky Networks, LLC, according to a statement issued by Gogo.
The court's Sept. 30, 2026 ruling on post-trial motions in SmartSky Networks, LLC v. Gogo Business Aviation, LLC and Gogo Inc. concluded that SmartSky failed to prove any recoverable damages. The court also denied SmartSky's requests for enhanced damages, ongoing royalties, and interest.
In its ruling, the court found that SmartSky's damages award was "untethered to the evidentiary record, relying on assumptions that could not be reconciled with the facts of the case," according to a quote attributed to Gogo in the statement.
The ruling is subject to appeal.
