ANI Pharmaceuticals, Inc. (Nasdaq: ANIP) announced that a Delaware trial court denied its post-trial motions for a new trial and judgment as a matter of law in its case against CG Oncology, according to a press release dated July 16, 2026.
Judge Sheldon K. Rennie issued the ruling on July 16, 2026. ANI stated it intends to appeal to the Delaware Supreme Court.
The dispute centers on assets ANI sold to CG Oncology under a 2010 agreement between the parties. ANI is seeking to recover the value of those assets, including what it claims is a 5% running royalty on future worldwide sales of cretostimogene grenadenorepvec.
"ANI respectfully disagrees with the Court's decision and intends to vigorously pursue its legal rights, including to receive a 5% running royalty on future worldwide sales of cretostimogene grenadenorepvec, by appealing to the Delaware Supreme Court," said Nikhil Lalwani, President and Chief Executive Officer of ANI.
