Court awards Natera 30% ongoing royalty in patent dispute

Natera Inc. (NASDAQ: NTRA) announced that a federal court in Delaware ordered a 30% ongoing royalty on post-injunction revenues from infringing minimal residual disease-related product sales in its patent litigation against ArcherDx and Invitae.
The court issued the decision on April 6, 2026, following a previous injunction dated November 21, 2023. The ongoing royalty applies to revenues from products that fall within exceptions to the injunction. A jury had previously awarded an effective royalty of 20.5% on pre-injunction revenues, which remains unchanged.
The court upheld the validity of all three asserted minimal residual disease patents and preserved damages related to Invitae's products in this category. The jury's verdict regarding patent validity and direct infringement for non-minimal residual disease products also remains intact.
Natera operates as a cell-free DNA and precision medicine company focused on oncology, women's health, and organ health. The company maintains over 650 issued or pending patents, including patents related to minimal residual disease testing.
