Item 1.04 Mine Safety - Reporting of Shutdowns and Patterns of Violations.
Section 1503(b)(1) of the Dodd-Frank Act requires the disclosure on a Current Report on Form 8-K of the receipt of an imminent danger order (an “Order”) issued under section 107(a) of the Federal Mine Safety and Health Act of 1977 (the “Mine Act”) by the Mine Safety and Health Administration.
On August 14, 2026, The Coteau Properties Company, a subsidiary of NACCO Industries, Inc. (the “Company”) received an Order under Section 107(a) of the Mine Act at the Freedom Mine located in Beulah, North Dakota. The Order stated that one miner was exposed to a fall hazard while working from a rolling stairway. No injuries occurred as a result of the conditions giving rise to the Order. The Company reserves its right to contest the 107(a) Order.
