Item 8.01 Other Events
On July 22, 2021, the Registrant was informed that the United States Court of Appeals for the Third District affirmed the District Court’s ruling in favor of the Registrant. The ruling was in connection with the Federal Trade Commission complaint filed against the Registrant in November 2016, alleging, among other matters, that the Registrant did not have substantiation for claims made by the Registrant regarding the R-value and energy efficiency of its INSULTIX House Wrap products. The Court stated, in relevant part, “Because the FTC failed to prove that IDI’s claims were false or unsubstantiated, the District Court correctly granted IDI’s motion for judgment on partial findings, and we will therefore affirm.” The case number is No.20-3379.
