Federal Court Awards Damages, Fees and Costs Following ProSomnus Intellectual Property Enforcement Action

SAN FRANCISCO, Aug. 31, 2026 (GLOBE NEWSWIRE) -- ProSomnus Sleep Technologies (“ProSomnus”), the pioneer and global leader in Smart Sleep Medicine, today announced a significant victory in its intellectual property enforcement action, reinforcing the Company's commitment to protecting the innovations, technologies, and proprietary assets that support advances in sleep medicine.

The United States District Court for the Southern District of Florida adopted in full the Magistrate Judge's Report and Recommendation, awarding ProSomnus $100,000 in damages against each of the four Defendants, together with more than $80,000 in attorneys' fees and costs. The Court's decision concludes a successful intellectual property enforcement action brought by ProSomnus to protect assets developed through years of investment in research, product development, clinical evidence generation, manufacturing, and commercialization.

Intellectual property protection plays a critical role in healthcare innovation. Developing new medical technologies requires substantial investments in research, engineering, clinical evidence generation, regulatory compliance, quality systems, provider education, manufacturing, and commercialization. ProSomnus believes that patients, providers, and payers are best served when companies compete through innovation, clinical evidence, product quality, and patient outcomes rather than through the unauthorized use of another company's intellectual property. Competition based on infringement and misappropriation undermines the incentives that drive investment in new technologies, clinical research, and healthcare innovation.

“Protecting intellectual property is not simply about protecting a company. It is about protecting patients who ultimately benefit from it,” said Len Liptak, Founder and Chief Executive Officer of ProSomnus. “Healthcare innovation requires substantial investments in research, engineering, clinical evidence generation, regulatory compliance, quality systems, and provider education. Intellectual property theft, misuse, and infringement undermine those investments and weaken the incentives that drive medical innovation. Patients benefit when innovators are rewarded for creating better solutions. Innovation suffers when others seek to benefit from investments they did not make. ProSomnus will continue to actively protect and enforce its intellectual property rights because doing so helps ensure that patients, providers, and payers continue to benefit from meaningful advances in sleep medicine.”

“This outcome reflects not only a legal victory, but a commitment to the principle that companies must compete through their own innovation, not through the misappropriation of a competitor's proprietary assets,” said Patricia Dodson, legal counsel for ProSomnus with Lippes Mathias LLP.

The outcome reinforces ProSomnus's commitment to protecting its innovations, technologies, brands, know-how, trade secrets, and other proprietary assets. The Company intends to continue strengthening its intellectual property portfolio and, when necessary, pursuing appropriate legal remedies to protect innovations that create value for patients, providers, healthcare systems, and payers. ProSomnus believes that robust intellectual property protection promotes fair competition, encourages continued investment in innovation, and advances the development of technologies that improve patient outcomes.
