Insurance Law Podcast Discusses Canine Liability Under New York Law
OLDWICK, N.J.--(BUSINESS WIRE)-- A.M. Best has released the latest installment of the Insurance Law Podcast, a series that examines timely insurance issues from an attorney’s point of view.
This episode features Attorney Jeffrey Baron, owner of Baron Law Firm, located in East Northport, NY. Mr. Baron has practiced personal injury defense litigation since 1996. His primary area of practice is in premises and automobile liabilities. The discussion addresses canine liability and examines why it is becoming a more prevalent area of law.
Mr. Baron begins by explaining the basic rules governing liability in dog bite cases. He provides an example of a negligence claim, as compared to a strict liability claim. He continues by explaining why a dog owner cannot be held liable under a theory of negligence in New York and further describes the circumstances under which a landlord can be held liable if his/her tenant’s dog attacks someone. Mr. Baron concludes by suggesting what insurance carriers need to consider in reference to canine liability.
