Seer wins EU patent case, ITC probes Nanomics over IP claims

Seer, Inc. (NASDAQ: SEER) announced two developments related to its intellectual property portfolio covering nanoparticle protein enrichment technology, according to a press release issued July 1, 2026.

On June 25, 2026, the European Patent Office (EPO) ruled that European Patent No. EP4056263 will be maintained, following an opposition by an unnamed party that sought to revoke the patent. The patent covers particle-based enrichment for proteomics. A written decision from the EPO is expected within approximately two months. The patent is owned by The Brigham and Women's Hospital and exclusively licensed to Seer.

On June 29, 2026, the U.S. International Trade Commission (ITC) instituted an investigation into Nanomics Biotechnology Co., Ltd. over the alleged importation of products that Seer claims infringe five of its U.S. patents. The ITC opened the investigation despite a June 10, 2026, request by Nanomics that it decline to do so. The investigation centers on Nanomics' Proteonano kits and workstations. Seer is seeking a limited exclusion order to bar those products from being imported and sold in the United States. The Brigham and Women's Hospital has joined the ITC action as a co-complainant.

The ITC investigation follows a complaint Seer filed on May 28, 2026, and runs parallel to a patent infringement suit filed in U.S. federal district court on May 12, 2026.

"The European Patent Office has upheld a key patent covering our particle-based enrichment technology, and the U.S. International Trade Commission has instituted an investigation into Nanomics despite the company's opposition," said Omid Farokhzad, Chair and Chief Executive Officer of Seer.

Seer states it holds a portfolio of more than 250 patent applications and issued patents, including 84 issued patents worldwide. In March 2026, the U.S. Patent Trial and Appeal Board issued a decision upholding key claims of U.S. Patent No. 11,435,360 in a separate inter partes review proceeding.
