In January, Macy’s (NYSE: M) sued Martha Stewart Living to stop it from executing on a sales agreement with J.C. Penny (NYSE: JCP). Last month a judged granted Macy’s a preliminary injunction. Now Macy’s lawyers are setting their sights on J.C. Penny.
In a suit filed today, Macy’s said J.C. Penney’s copycat line would substantial damages and threaten to inflict incalculable further harm and that the Martha Stewart pact is “transparently designed to eliminate the competitive advantage that Macy’s enjoys in the area of home products.”
