ITC opens second patent investigation into Samsung over Netlist claims

The U.S. International Trade Commission (ITC) has instituted a second investigation, ITC Inv. No. 337-TA-1511, into Samsung and several of its customers — Google, Supermicro, Nvidia, and Broadcom — following a complaint filed by Netlist, Inc. (OTCQB: NLST) on June 16, 2026.
The ITC will determine whether Samsung memory products should be banned from importation into the United States for allegedly infringing two Netlist patents: U.S. Patent Nos. 12,646,537 and 12,650,937. The patents cover Samsung's high-bandwidth memory (HBM) products and Samsung's DDR5 RDIMMs and MRDIMMs, respectively. Netlist is seeking exclusion and cease and desist orders against all named respondents.
C.K. Hong, Netlist's chief executive officer, said, "We are committed to protecting our intellectual property and pleased with the ITC's decision to open this second investigation into the unauthorized use of Netlist patents by Samsung and its customers."
This follows a first ITC complaint Netlist filed on September 30, 2025, in which the ITC is investigating whether Samsung, Google, and Supermicro infringe six Netlist patents related to DDR5 memory modules and HBM products. An evidentiary hearing in that case is scheduled to begin in November 2026.
