The Regional Court of Hamburg has issued a preliminary injunction against Elite Robots Deutschland GmbH in a copyright infringement case brought by Teradyne Robotics A/S, a subsidiary of Teradyne Inc. (NASDAQ: TER).
The court prohibited Elite Robots Germany from offering or distributing what it deemed infringing software and all products containing this software in Germany until further notice. The German subsidiary must also provide information about the infringing acts and disclose customer information.
Teradyne Robotics filed the legal action in February, alleging that Elite Robots infringed on Universal Robots' software copyrights. Universal Robots is a division of Teradyne Robotics that manufactures collaborative robots.
"We believe we have irrefutable evidence of copyright infringement and, while this is not a final ruling from the court, it is a clear indication that we have a very strong case," said Jean-Pierre Hathout, President of the Teradyne Robotics Group.
Teradyne Robotics stated it intends to pursue legal action against Elite Robots' distributors and partners if they continue offering the allegedly infringing software.
The preliminary injunction represents an interim measure while the copyright infringement case proceeds through the German court system. A preliminary injunction does not constitute a final judgment on the merits of the case.
