Evoke Pharma gets patent approval extending GIMOTI protection to 2036

Evoke Pharma Inc. (NASDAQ: EVOK) received a Notice of Allowance from the United States Patent and Trademark Office for a patent application covering the use of GIMOTI nasal spray in patients with moderate to severe gastroparesis symptoms, according to a company statement.
The allowed application continues U.S. Patent No. 11,517,545 and expands the company's intellectual property for intranasal metoclopramide. The patent will expire in December 2036 once issued, and Evoke plans to list it in the FDA's Orange Book to extend market exclusivity for GIMOTI beyond existing patents.
GIMOTI is the only FDA-approved, non-oral, self-administered formulation of metoclopramide indicated for relief of symptoms associated with acute and recurrent diabetic gastroparesis in adults. The nasal spray delivery addresses gastroparesis patients' difficulty absorbing oral medications due to delayed gastric emptying.
CEO Matt D'Onofrio stated the patent "adds meaningful value to the GIMOTI franchise by reinforcing protection around how and in whom the therapy is used."
The company has filed another U.S. continuation application to pursue additional claims for treatments in this patient population. Evoke Pharma focuses on gastrointestinal disorder treatments and developed and markets GIMOTI for diabetic gastroparesis, a condition affecting millions of patients worldwide where the stomach empties too slowly.
Metoclopramide was previously only available in oral and injectable formulations and remains the only drug approved in the United States to treat gastroparesis.
