Amsterdam court dismisses Shell and Repsol damages claims against Celanese

The Amsterdam District Court dismissed a damages claim brought by Shell Chemicals Europe B.V. against Celanese Corporation (NYSE: CE) and its co-defendants, according to a press release from the company.
The court also dismissed a separate claim from certain Repsol entities, represented by Stichting Ethylene Claims, which had sought a declaratory judgment of liability against Celanese and its co-defendants.
Both cases were follow-on litigation stemming from a 2020 settlement Celanese reached with the European Commission related to past ethylene purchases in North-Western Europe.
"We welcome the Amsterdam District Court's decisions to dismiss both Shell's and Repsol's claims in their entirety, and appreciate the Court's careful consideration of the evidence," Celanese said in a statement. "Celanese has consistently maintained that there was no harm to the claimants or other market participants, and we are pleased that the Court's decisions have confirmed our position that the claimants in these cases are not entitled to recover damages. Celanese remains committed to vigorously defending against the remaining claims in the Dutch and German courts."
