Alpha Modus files second patent lawsuit against Kroger

Alpha Modus Corp. (NASDAQ: AMOD) filed a patent infringement lawsuit against The Kroger Co. on August 29, 2025, in the United States District Court for the Eastern District of Texas. The lawsuit represents the second legal action between the companies.
The complaint alleges Kroger infringes on seven Alpha Modus patents and one pending patent application covering technologies for real-time consumer monitoring, AI-powered advertising, seamless checkout, and inventory management. Alpha Modus targets specific Kroger technologies including Barrows Connected Store with BlueZoo analytics, Everseen Visual AI technology, Kroger Precision Marketing, 84.51° analytics, KroGO smart carts, Scan, Bag, Go, Kroger Pay, QueVision, and EDGE shelving.
This lawsuit differs from the companies' previous dispute, which focused on Kroger's implementation of Cooler Screens technology. The current case addresses Kroger's own digital platforms directly.
"Settling our dispute over Cooler Screens did not mean Kroger had a free pass to infringe Alpha Modus's broader portfolio," said William Alessi, CEO of Alpha Modus. "Kroger must face up to the fact that it is infringing directly on Alpha Modus's technology."
Alpha Modus seeks treble damages, attorneys' fees, and a permanent injunction, citing willful infringement of its intellectual property rights. The company alleges Kroger continued deploying the contested technologies after being informed of Alpha Modus's patent rights.
Alpha Modus describes itself as a developer of AI-driven retail technology, intelligent kiosks, and consumer engagement tools. The company states its patent portfolio has been cited by major corporations in AI-driven retail innovations.
