Meta faces EU antitrust probe over WhatsApp AI provider policy

Investing.com -- The European Commission said on Thursday it has launched a formal antitrust investigation into Meta’s new policy that restricts artificial intelligence providers from using WhatsApp’s business communication tools.


The investigation focuses on Meta’s October 2025 policy that prohibits AI providers from using the WhatsApp Business Solution when AI is the primary service offered. The Commission is concerned this policy could prevent third-party AI providers from offering their services through WhatsApp in the European Economic Area.


Under the new policy, businesses can still use AI for ancillary functions like automated customer support via WhatsApp. However, the Commission noted that while competing AI providers may be blocked from reaching customers through the platform, Meta’s own AI service "Meta AI" would remain accessible.


For AI providers already on WhatsApp, the policy update will apply from January 15, 2026, while for new AI providers it has been applicable since October 15, 2025.


The formal investigation will cover the European Economic Area except for Italy, where the national competition authority has ongoing proceedings concerning Meta’s conduct.


"AI markets are booming in Europe and beyond. We must ensure European citizens and businesses can benefit fully from this technological revolution and act to prevent dominant digital incumbents from abusing their power to crowd out innovative competitors," said Teresa Ribera, Executive Vice-President for Clean, Just and Competitive Transition.


The Commission stated it will carry out its in-depth investigation as a priority, though there is no legal deadline for its completion. If proven, the practices may breach EU competition rules that prohibit the abuse of a dominant position.
