A federal appeals court re-instated an injunction against Microsoft Corp. (NASDAQ: MSFT) that will bar the software company from selling current versions of its popular Word software due to patent infringement.
The court affirmed a $290 million patent infringement judgment against Microsoft with the injunction that will go into effect on Jan. 11.
The company said that it was prepared for such a ruling, and will have altered versions of Word 2007 ready for sale when the injunction kicks in, which will not infringe on the patent at issue.
Microsoft added that the new beta versions of Word 2010 and Office 2010 do not have software that will infringe on the patent.
The Toronto-based company i4i Inc. convinced the Texas federal court that the recent versions of Word infringed on a company patent for software that deals with the altering of the architecture of a document.
The component of Word call "Custom XML" will have to be removed by Microsoft to avoid further penalties. Microsoft said that it will work around or disable the component that caused the injunction. The company also said that it may take the appeal to the Supreme Court or ask the Federal Circuit to look at the case again.
Shares of Microsoft are up 0.88 percent in late market movement to $30.80.
