US appeals court grants stay on Aeromexico-Delta cooperation termination

The U.S. Court of Appeals for the Eleventh Circuit granted a stay requested by Grupo Aeromexico (NYSE: AERO) and Delta Air Lines regarding a Department of Transportation order that would have terminated their joint cooperation agreement.

The DOT issued a final order on September 15, 2025, ending antitrust immunity and withdrawing approval for the Joint Cooperation Agreement between the two airlines. The termination was scheduled to take effect on January 1, 2026.

The court's decision on November 12, 2025, suspends the effectiveness of the DOT's final order while judicial review of the matter continues. Both airlines jointly requested the stay from the appeals court.

The original DOT order would have ended the partnership arrangement that allowed the airlines to coordinate flights, pricing, and schedules between the United States and Mexico under antitrust immunity.

Aeromexico announced the court's decision in a statement based on the stay granted by the Eleventh Circuit. The stay remains in place pending resolution of the judicial review process.
