Cytokinetics sues Bristol-Myers Squibb over aficamten patent dispute

Cytokinetics (NASDAQ: CYTK) filed a complaint on August 13, 2026, in the U.S. District Court for the District of Delaware against Bristol-Myers Squibb Company and its subsidiary MyoKardia, Inc., seeking a declaratory judgment related to a patent dispute over its heart drug aficamten.

The complaint seeks a judgment that Cytokinetics does not infringe U.S. Patent No. 12,616,697, held by the defendants, and that the patent's claims are invalid. Aficamten is marketed by Cytokinetics under the brand name Myqorzo.

Among the remedies requested, Cytokinetics is asking the court to permanently enjoin Bristol-Myers Squibb and MyoKardia from threatening or initiating infringement litigation against the company or against users, customers, and distributors of Myqorzo. The company is also seeking attorneys' fees and costs, and has demanded a jury trial on all triable issues.

Cytokinetics stated it intends to vigorously assert its legal rights but acknowledged that the outcome of any litigation is inherently uncertain. The company said it will provide updates on the matter through filings with the U.S. Securities and Exchange Commission.
