Apple (Nasdaq: AAPL) shares are lower on the session following news that it was unsuccessful in one of the most important patent cases to-date in Europe.
Apple was seeking to appeal a ruling in which Samsung would be able to copy registered designs of Apple's tablets.
The U.K.'s High Court originally said that, while Samsung's tablet design has some similarities to Apple's iPad, it didn't infringe on those designs. Thursday, Britain's Court of Appeal upheld that ruling, making it valid throughout Europe.
Though Apple can appeal to the Supreme Court, its unlikely that that would happen.
Shares of Apple are down 1 percent Thursday.
