Apple (AAPL) Exec Says 'Highly Protected' Patents Licensed to Microsoft (MSFT) Along with Anti-Cloning Agreement

Microsoft Corp. (Nasdaq: MSFT) ticked a little higher Monday afternoon following reports that it is licensing certain key design patents from Apple, Inc. (Nasdaq: AAPL).

In a testimony during its patent trial against Samsung, Apple's patent licensing director Boris Teksler said the licenses were grated with an "anti-cloning" clause, whereby Microsoft would not release a product which looked like an iPhone or iPad, both of Apple's hot-selling mobile devices.

Teksler said Apple reached out to Samsung in 2010 with a handful of patents, but retained user experience IP which Apple categorized as "highly protected." He said he could count on one hand the number of times Apple licensed out the highly-protected patents.

Samsung and Apple failed to reach an agreement on the patents, leading to Apple filing a lawsuit in April 2011.

Shares of Apple are up about 1 percent while Microsft is down half-a-percent on the session.
