Auriga Reiterates a 'Buy' on Jazz Pharmaceuticals (JAZZ) After Call With Patent Attorney

Auriga reiterates a 'Buy' on Jazz Pharmaceuticals (NASDAQ: JAZZ) price target of $57.00.
Analyst, Defei Yang, said, "For JAZZ to win the patent challenge case, it only needs one claim from one of the nine patents to be upheld. There are nine patents in litigation. Among them, three are formulation patents, one is method of use patent and five remaining patents are associated with distribution system. There are about thirty five claims spreading over nine patents. Patentability on REMS should have already been addressed. The U.S. Supreme Court, on June 28, 2010, decided the long-awaited Bilski case, affirming the Federal Circuit’s judgment. The Court ruled that a business process that if it is nothing more an abstract idea, it does not meet the patentability criteria. This decision has raised the bar on patent eligibility of business process. Our legal consultant thinks that distribution system patents are business process patents and thus Bilski case is a relevant reference point. Since three out of the five distribution patents (‘106, ‘107 and ‘171) are granted post the Bilski decision, it is highly likely that the three patents could sustain the challenge of the patentability test."
