Raymond James analyst Ryan Deschner reiterated a Strong Buy rating on Liquidia Technologies (NASDAQ: LQDA)

The analyst comments "The U.S. Supreme Court has denied UTHR’s petition to rulings that found that all claims of the ‘793 patent related to Tyvaso (patent title: “treprostinil administration by inhalation”) were invalid. This denial of appeal is final and completely removes the overhang related to the original HatchWaxman lawsuit alleging infringement on UTHR’s ‘793, ‘066, and ‘901 patents that triggered the 30-month stay in 2022. Given UTHR’s track record of invalidated patent claims and failed infringement lawsuits vis-a-vis Yutrepia, we think it is likely LQDA will prevail in a separate patent lawsuit involving a patent that is specific to the PH-ILD indication (the ‘327 patent), particularly since a District Court judge has already denied preliminary injunction. Given, at this point, no patents are found to be infringed and there are no legal impediments (i.e., stays or injunctions) to final approval and launch in PAH and PH-ILD, Yutrepia has a clear path to final approval and launch in May 2025 subject to resolution of the litigation with FDA."
