Imclone Systems Inc. (Nasdaq: IMCL) 9.5% LOWER; Loses patent ruling to Yeda Research

Foxhollow Technologies Inc. (Nasdaq: FOXH) 6.6% LOWER; research agreement with Merck & Co (NYSE: MRK) terminated recently. Company in negotiations with Merck regarding the renewal and extension of the collaboration.

FactSet (NYSE: FDS) 5% HIGHER; reports Q4 earnings of $0.43 per share, ex-benefit, 1 cent better than estimates. Revenues came in at $105.2 million versus the consensus of $103.9 million. Sees Q1 revenues of of $106-$109 million versus the consensus of $105.8 million.

Maxim Integrated Products, Inc. (NASDAQ: MXIM) 4.7% LOWER; expects first quarter revenues for fiscal 2007 to be flat to down 3% compared to revenues of the fourth quarter of fiscal 2006 and GAAP earnings to be $0.32 - $0.34 per share excluding one time charges. Current consensus is $0.38 for Q1 EPS.

Akamai Technologies Inc. (Nasdaq: AKAM) 2% LOWER; Piper Jaffray downgrade

Micron Technology Inc. (NYSE: MU) 2% LOWER; Citigroup downgrade

Con-Way, Inc. (NYSE: CNW) 1.8% LOWER; announced that third-quarter earnings from continuing operations are expected to be between $1.10 and $1.15 per diluted share. Current consensus is $1.24.

Research In Motion Ltd. (Nasdaq: RIMM) 1.5% HIGHER; Needham upgrade

Motorola Inc. (NYSE: MOT) 0.7% LOWER; Motorola, Inc. and Symbol Technologies (NYSE: SBL) signed a definitive merger agreement, under which Motorola has agreed to acquire all of the outstanding shares of Symbol for $15 per share in cash. The transaction has a total equity value of approximately $3.9 billion on a fully-diluted basis.

hi/fn Inc. (Nasdaq: HIFN) INDICATED LOWER; expects revenues for its fourth quarter of fiscal year 2006, ending September 30, 2006, to fall short of expectations by approximately 20%.
