According to Fox Business Network's Charles Gasparino, no. Herbalife said Ackman "isn't an investor." Anyway, Gasparino notes that Ackman is on a scuba diving trip in Burma.
Herbalife is also said to be paying attorney David Boies a "substantial" retainer in the eight-figure range. Boies will be reviewing Ackman's claims that Herbalife is a "pyramid scheme."
Shares of Herbalife are up 3.4 percent early Thursday.
