Liquidia settles all litigation with United Therapeutics for $380.7M

October 13, 2026 5:51 PM

Liquidia Corporation (Nasdaq: LQDA) announced a global settlement with United Therapeutics Corporation (Nasdaq: UTHR) that resolves all six pending lawsuits between the two companies, according to a press release issued Oct. 13, 2026.

Under the terms of the agreement, Liquidia will make a net payment of $175 million to United Therapeutics within 30 business days, which accounts for funds paid by United Therapeutics to Liquidia to resolve related antitrust litigation. Liquidia will then pay an additional $145.4 million in two equal installments of $72.7 million, due on or before January 31, 2027, and April 30, 2027. Separately, Liquidia will pay $60.3 million to parties with interests in the antitrust litigation tied to Treprostinil Injection, bringing the total net payment to $380.7 million.

The settlement follows a Sept. 30, 2026, ruling by the U.S. District Court for the District of Delaware finding that claims of U.S. Patent No. 11,826,327, covering treatment of pulmonary hypertension associated with interstitial lung disease (PH-ILD) with inhaled treprostinil, are valid and infringed by Liquidia. As part of the settlement, Liquidia agreed not to appeal the ruling and submitted a supplement to remove the PH-ILD indication from YUTREPIA's label.

YUTREPIA (treprostinil) inhalation powder will remain available for patients with pulmonary arterial hypertension (PAH). Liquidia also terminated its promotional agreement tied to Treprostinil Injection.

Preliminary and unaudited figures show Liquidia recorded $222.7 million in YUTREPIA net product sales in the third quarter of 2026, with total cash and cash equivalents of $396.1 million as of Sept. 30, 2026. The company said it expects to fund settlement payments from ongoing YUTREPIA sales and existing cash without requiring additional financing.

The settlement includes mutual releases and is not an admission of liability by either party. Liquidia said it plans to continue clinical development of YUTREPIA and its investigational candidate L606. A full update is expected on the company's third-quarter 2026 earnings call in November.
