Liquidia shares crater after court rules for United Therapeutics
Investing.com -- Liquidia Corp shares fell Wednesday after a U.S. District Court in Delaware ruled the company infringed two patent claims held by United Therapeutics Corp. United Therapeutics shares rose more than 13%.
The court determined that claims 1 and 14 of U.S. Patent No. 11,826,327 were valid and infringed by Liquidia. These claims cover treatment of pulmonary hypertension with interstitial lung disease using inhaled treprostinil, including dry powder formulations. The court invalidated the remaining four claims asserted against Liquidia.
The parties must submit a proposed judgment, including remedies, to the court within one week. United Therapeutics requested injunctive relief in post-trial briefs that could limit availability of Liquidia's YUTREPIA (treprostinil) inhalation powder.
Liquidia CEO Roger Jeffs said the company disagrees with the ruling on claims 1 and 14 and will pursue appellate options. "As previously communicated to the Court, we intend to submit a supplement to YUTREPIA's New Drug Application to the FDA to remove PH-ILD from the label," Jeffs said.

Liquidia said it cannot estimate the range of potential outcomes or financial exposure, citing variables including potential appeals and further proceedings. Possible remedies range from removing the PH-ILD indication from YUTREPIA's label to broader restrictions on product availability.
YUTREPIA received approval in 2025 for treatment of pulmonary arterial hypertension and PH-ILD. United Therapeutics filed the lawsuit under the Hatch-Waxman Act.
