ITC opens patent investigation into Micron over memory products

The U.S. International Trade Commission (ITC) has instituted an investigation, ITC Inv. No. 337-TA-1523, into Micron Technology, Super Micro Computer, Hewlett Packard Enterprise, and Lenovo over alleged patent infringement involving memory products, according to a statement from Netlist, Inc. (OTCQB: NLST).

The investigation follows a complaint filed by Netlist on August 11, 2026. The ITC will determine whether Micron memory products should be banned from importation into the United States for infringing four Netlist patents: U.S. Patent Nos. 10,025,731, 10,217,523, 12,373,366, and 12,675,407. The patents relate to DDR5 RDIMMs and MRDIMMs.

Netlist is seeking exclusion orders and cease and desist orders to halt importation of the allegedly infringing products by all named respondents.

C.K. Hong, Netlist's chief executive officer, said, "We are pleased with the ITC's decision to institute this investigation. The Samsung agreement established an important industry benchmark for the value of our IP. We intend to continue our enforcement efforts against unauthorized users such as Micron."

ITC cases proceed on an expedited basis, commonly reaching trial within one year of institution.
