A U.S. District Court in Delaware entered final judgment on Aug. 21, 2026, in favor of TwinStrand Biosciences and the University of Washington in a patent infringement case against Guardant Health (Nasdaq: GH), awarding more than $245.2 million in damages, accrued royalties and interest.

The judgment preserves a November 2023 jury verdict finding that Guardant Health willfully infringed two patents — U.S. Patent Nos. 10,287,631 and 10,760,127 — underlying TwinStrand's Duplex Sequencing technology across 11 products and services.

The total award breaks down as follows: $83.4 million in damages for infringement through June 30, 2023; $19.5 million in supplemental damages for sales between July 1, 2023, and Feb. 5, 2024; $119.4 million in accrued royalties at a 6% rate for sales between Feb. 5, 2024, and May 31, 2026; and $22.9 million in pre-judgment and post-judgment interest. The 6% royalty applied by the jury represented approximately 90% of Guardant Health's total revenue during the relevant infringement period.

The court ordered Guardant Health to continue paying a 6% royalty on sales of the covered products and services from June 1, 2026, through patent expiration on March 15, 2033, payable quarterly. Interest continues to accrue on the unpaid judgment.

The court also upheld the validity of the asserted claims of both patents and denied Guardant Health's post-trial motions to overturn the verdict or obtain a new trial. All of Guardant Health's counterclaims against TwinStrand were either dismissed or withdrawn before trial.

The 11 Guardant Health products and services covered by the judgment include Guardant360 CDx, Guardant Reveal/LUNAR-1, Guardant LUNAR-2/Shield, and eight others. Guardant Health is also required to provide TwinStrand and the University of Washington with quarterly accounting of all U.S. sales of the covered products. Patent-related proceedings remain ongoing before the U.S. Patent and Trademark Office and the Patent Trial and Appeal Board.
