Abacus Global Management, Inc. (NYSE: ABX) has filed a motion seeking court permission to file a second amended complaint in its ongoing defamation lawsuit against Coventry First LLC and its Executive Chairman, Alan Buerger, in the U.S. District Court for the Middle District of Florida, Orlando Division.

The proposed amended complaint catalogs nearly 20 alleged false and misleading statements about Abacus, its business model, and its use of third-party life expectancy data. The filing adds a claim for defamation per se, which carries punitive damages, and states that Coventry's potential liability may exceed $100 million.

The amended complaint also alleges that Coventry itself purchased more than 4,000 life-expectancy reports from Lapetus, a life expectancy provider, and that Coventry and its affiliates purchased more Lapetus reports than Abacus did between 2019 and 2022 — even as Coventry now claims that data is unreliable.

The motion follows a June 26, 2026 ruling in which the court denied Coventry's motion to dismiss, allowing three claims — defamation, defamation by implication, and a violation of Florida's Deceptive and Unfair Trade Practices Act — to proceed to discovery. Abacus has also added a fourth count of defamation per se in the proposed amended complaint.

"This amended complaint makes clear what we've said from the beginning: Coventry's attacks on Abacus over the last three years were never a series of isolated remarks, but rather part of a sustained, coordinated misinformation campaign intended to harm Abacus's business and reputation," said Jay Jackson, Chairman and Chief Executive Officer of Abacus.

The proposed filing also references a Coventry press release dated August 4, 2026, which Abacus alleges included a selective and misleading use of discovery materials. Discovery, including depositions of Coventry's executive team, is currently underway. The case is filed under Case No. 6:25-cv-01401-RBD-RMN.
