EyePoint Pharmaceuticals settles False Claims Act case for $4.7M
EyePoint Pharmaceuticals (NASDAQ: EYPT) has reached a settlement agreement with the U.S. Department of Justice and related federal agencies over alleged civil violations tied to the sales and marketing of its eye care product DEXYCU, which the company commercialized between 2019 and 2023.
According to a press release, the settlement, effective July 17, 2026, resolves potential claims under the False Claims Act, the Civil Monetary Penalties Law, and the Administrative False Claims Act, among other legal theories. The company stated the agreement does not constitute an admission of liability.
Under the terms, EyePoint agreed to pay $4,678,981.86, plus interest at 4.25% per annum from January 28, 2026. Of that amount, $4,657,463.18 plus interest goes to the United States, and $21,518.68 plus interest goes to participating states, both due within 14 days of the effective date. The company also agreed to pay $166,500 in attorneys' fees and costs to the relator's counsel within 60 days. EyePoint said it plans to use cash on hand to cover these payments.
In exchange for payment, the DOJ, the Office of Inspector General of the Department of Health and Human Services, the Defense Health Agency, and the relator agreed to release EyePoint from civil and administrative monetary liability related to the covered conduct and to dismiss the underlying civil action.
Separately, on July 13, 2026, EyePoint entered into a five-year Corporate Integrity Agreement with the OIG-HHS. The agreement requires the company to maintain a compliance officer, a compliance committee, board-level oversight of federal healthcare compliance matters, and an independent review organization, among other obligations. Non-compliance could result in monetary penalties or exclusion from Medicare, Medicaid, or other federal healthcare programs. In exchange, OIG-HHS agreed not to seek the company's exclusion from federal health care programs as a result of the covered conduct.
