The U.S. Court of Appeals for the Federal Circuit affirmed a lower court ruling that upholds CorMedix Therapeutics' (NASDAQ: CRMD) patents for Minocin for Injection and finds Nexus Pharmaceuticals infringed those patents.

The Federal Circuit decision upheld a 2023 district court ruling from the U.S. District Court for the Northern District of Illinois following a four-day bench trial. The lower court had found in favor of CorMedix's subsidiary Melinta Therapeutics on patent infringement and validity issues.

The appeals court rejected Nexus Pharmaceuticals' challenge to the patent validity and affirmed a permanent injunction preventing Nexus from marketing its generic minocycline product before the patents expire. The patents are listed in the FDA Orange Book and cover CorMedix's reformulation of intravenous minocycline.

Minocin is a tetracycline-derived antibiotic used in hospitals and acute care settings for patients with serious and drug-resistant infections.
