PreOmics GmbH and Biognosys AG announced that the U.S. Patent Trial and Appeal Board revoked central claims of U.S. Patent No. 11,435,360 in an inter partes review proceeding.

The patent is owned by The Brigham and Women's Hospital and exclusively licensed to Seer, Inc. (NYSE: SEER). The USPTO invalidated the sole independent claim and other claims of the patent, which attempted to cover workflows using multiple nanoparticle types to form biomolecule coronas and detect proteins across a wide dynamic range.

The PTAB specifically struck down Claim 1 in the IPR proceeding IPR2024-01473. Dr. Oliver Rinner, co-founder and managing director of Biognosys AG, stated that the outcome confirms the fundamental concepts were already known in scientific literature.

Both PreOmics GmbH and Biognosys AG are subsidiaries of Bruker Corporation (NASDAQ: BRKR). The companies operate in the proteomics and multiomics workflows sector, providing sample preparation and software solutions for researchers.

The companies said they remain committed to advancing their technologies in the proteomics field following the favorable patent ruling.
