Delaware judge steps down from Elon Musk cases after bias claims

March 30, 2026 10:46 AM

Investing.com -- A Delaware judge said Monday she will no longer oversee several lawsuits involving Elon Musk and his companies after the billionaire's attorneys claimed she showed bias against him.

Delaware Chancery Court Chief Judge Kathaleen St. J. McCormick said in a letter Monday that she will reassign several Musk-related cases. Last week, Musk's lawyers wrote to the court citing a LinkedIn screenshot that they said shows she supported a post celebrating Musk's defeat in a California civil fraud trial. A jury earlier this month found the billionaire defrauded Twitter Inc. shareholders before acquiring the platform in 2022.

McCormick denied the bias allegations in her letter to Musk's lawyers Monday. She said the recusal motion rests on a false premise that she supports a LinkedIn post about Musk, which she said she does not support. She stated she is not biased against the defendants in these cases.
