SEER wins patent challenge from Bruker subsidiaries
The Patent Trial and Appeal Board upheld key claims of a Seer Inc. (NASDAQ: SEER) patent covering protein enrichment technology after subsidiaries of Bruker Corporation challenged the intellectual property.
The board issued its final written decision on March 23, rejecting an inter partes review filed by PreOmics GmbH and Biognosys AG, both Bruker subsidiaries. The challenge targeted 11 of 29 claims in U.S. Patent No. 11,435,360 B2, which covers methods for analyzing biological samples using engineered nano- and microparticles.
A total of 23 claims remain valid following the decision, including five challenged claims and 18 unchallenged claims. The patent protects Seer's nanoparticle protein enrichment technology used in analyzing biological samples such as cells, tissues and biofluids.
The patent is owned by The Brigham and Women's Hospital Inc. and exclusively licensed to Seer. It covers technology that underlies Seer's Proteograph platform for deep proteomic analysis.
"The PTAB's decision affirms the strength of our technology and our Proteograph platform," said Omid Farokhzad, chair and chief executive officer of Seer.
Seer's Proteograph Product Suite integrates engineered nanoparticles, automation instrumentation and analytical software for proteomics analysis. The company maintains an intellectual property portfolio of more than 240 issued patents and pending patent applications worldwide, including 80 issued patents, according to the company's statement.
