The federal court overseeing thousands of DePuy ASR hip lawsuits (http://www.consumerinjurylawyers.com/DePuy/Hip-Replacement-Recall.html) has extended certain deadlines pertaining to plaintiffs who have not undergone revision surgery to replace their hip implant. According to an Order issued on April 1st in the U.S. District Court, Northern District of Ohio, non-revision plaintiffs who have elected to continue their cases now have until April 30, 2015 to complete initial discovery. The deadline for Non-Revision Election has also been extended to April 30th, with initial discovery now due 90 days from the submission of an election form. (In re: DePuy Orthopaedics, Inc. DePuy ASR Litigation
According to court documents, more than 7,000 DePuy ASR hip lawsuits have been filed in the Northern District of Ohio on behalf of individuals who allegedly suffered chronic pain, metallosis, premature device failure, and other debilitating complications related to its metal-on-metal design. DePuy Orthopaedics originally offered tolling agreements to non-revision plaintiffs via a Case Management Order issued on October 30, 2014. The tolling agreements will extend the statute of limitations governing a plaintiff's DePuy ASR lawsuit in return for its voluntary dismissal. Plaintiffs who elect this option will be permitted to refile their claim if they require revision of their ASR hip implant for a recall related reason in the future
Court records indicate that a DePuy ASR settlement program was announced in the Northern District of Ohio on November 19, 2013. Originally, eligibility for the settlement had only included those who had undergone a revision as of August 31, 2013. On February 20, 2015, eligibility was expanded to include DePuy ASR hip recipients who underwent revision surgery for recall-related reason by January 31, 2015. Plaintiffs wishing to participate in the expanded settlement program have until May 1, 2015 to submit their claim.
DePuy ASR hip recipients who were allegedly harmed by this metal-on-metal hip may be entitled to compensation for their injury-related damages.
