What is really a dividend

It looks like Fairpoint has just pulled something on its stockholders, but what. My 1099 says only about 22% of what I received was actually dividends and about 78% was return of capital. How can they get away with this? Looks like this has been goin on all year. Why weren't we informed that this was going to be the case. Their real dividend yield is zilch.
