Trans1 (Nasdaq: TSON) 39.1% LOWER; received subpoena issued from HHS OIG seeking documents from the period Jan. 2009 to October 6th of 2011. Trans1 cites Federal Healthcare Fraud and False Claims statute. The company has said no claims have been made against the company at this time.

Crocs (Nasdaq: CROX) 38.5% LOWER; cuts its Q3 EPS guidance from about 40 cents to 31-33 cents, which compares to the Street estimate of 40 cents. Lowers its sales outlook from about $280 million to $273-$275 million, vs. the consensus of $280.5 million. The stock was also downgraded at DA Davidson earlier.

Agenus (Nasdaq: AGEN) 32.7% HIGHER; surged midday following an SEC filing which discloses a Glaxo (NYSE: GSK) Phase 3 trial of RTS,S malaria vaccine candidate cut some risk of malaria. Click here to see full details.

American Public Education (Nasdaq: APEI) 27.3% LOWER; after holding extremely closely to the 200-day moving average over the last several trading sessions, the stock price has plunged below on heavy volume.

Hospira (NYSE: HSP) 22% LOWER; offers preliminary Q3 results: sales of $977 million, vs. the consensus of $1.07 billion, with EPS of 66 cents, vs. the Street estimate of 95 cents. Lowers its FY11 EPS guidance from $3.90-$4 to $2.95-$3.05, which compares to the Street estimate of $3.92.

Uranium Resources, Inc. (Nasdaq: URRE) 18.8% HIGHER; announced today that the Nuclear Regulatory Commission (NRC) reactivated its Source Materials License to conduct in-situ recovery (ISR) uranium mining in McKinley County, New Mexico. The license, which was originally issued in 1998 to Hydro Resources, Inc., Uranium Resources’ wholly-owned subsidiary, has been in timely renewal status since 2003. The reactivation effectively enables the use of the license by the Company for the production of uranium as defined in the license.

Halozyme Therapeutics, Inc. (Nasdaq: HALO) 17.6% HIGHER; reports that the Phase 3 HannaH trial, conducted by Roche (OTCBB: RHHBY), showed that women with HER2-positive early breast cancer who received a new, investigational subcutaneous (SC) injection of Herceptin (trastuzumab), experienced comparable results to Herceptin given as an intravenous (IV) infusion. JMP Securities upgraded the stock from Market Perform to Market Outperform with a new price target of $9.00.

O’Charley’s Inc. (Nasdaq: CHUX) 13.5% HIGHER; has completed a sale-leaseback of 50 O’Charley’s restaurant properties, which produced gross proceeds of approximately $105 million.

Active Power, Inc. (Nasdaq: ACPW) 14.1% LOWER; has appointed company director Jan Lindelow as interim president and CEO effective immediately. Lindelow succeeds Jim Clishem who has resigned as president and CEO and as a member of the company’s board of directors to pursue other interests. As previously announced, Active Power expects third quarter 2011 guidance to be between $18 million and $21 million in revenues with earnings per share between $(0.02) and $0.02. Any changes in cash and investments are expected to be due to changes in working capital requirements.

GTx, Inc. (Nasdaq: GTXI) 13.1% HIGHER; retaking the $4 level today. The stock rose more than 20 percent on Friday and only gave up 4 percent of that rise yesterday.

Meritage Homes (NYSE: MTH) 12.9% HIGHER; homebuilders higher as the NAHB Housing Index came in at 18, above the 15 expected, and its highest level since May 2010.
