ParkerVision, Inc. (Nasdaq: PRKR) 37% HIGHER; announced today that on February 20, 2013, the United States District Court for the Middle District of Florida issued its patent claim construction ruling, or "Markman Order", in the ongoing patent infringement action between ParkerVision and Qualcomm, Inc (Nasdaq: QCOM).

Repros Therapeutics Inc. (Nasdaq: RPRX) 32% HIGHER; provided a clinical update of its Androxal Phase 3 program following receipt of written guidance from the FDA. The FDA has informed Repros to proceed with the analysis of ZA-301 as previously planned, and that data should be evaluated both with and without patients from the high enrolling site where the patients' baseline characteristics appeared different from other sites in the study.

VeriFone Systems, Inc. (NYSE: PAY) 32% LOWER; announced certain preliminary financial results for its first quarter ended January 31, 2013. VeriFone expects to report Q1 non-GAAP net revenues in the range of $425 million to $430 million and Q1 GAAP net revenues in the range of $424 million to $428 million. VeriFone expects to report non-GAAP net income per share between $0.47 and $0.50 and GAAP net income per share between $0.07 and $0.10. *** The Street sees revs of $482.5 million and EPS of $0.73.

Berry Petroleum Company (NYSE: BRY) 21% HIGHER; LINN Energy, LLC (Nasdaq: LINE) and LinnCo, LLC (Nasdaq: LNCO) will acquire all of Berry's outstanding shares for total consideration of $4.3 billion, including the assumption of debt. The transaction, which is structured as a stock-for-stock merger of Berry with LinnCo followed by the acquisition of the Berry assets by LINN, is expected to be tax-free to Berry shareholders. This transaction represents the first ever acquisition of a public C-Corp by an upstream LLC or MLP.

Pegasystems, Inc. (NASDAQ: PEGA) 17% HIGHER; reported Q4 EPS of $0.65c $0.32 better than the analyst estimate of $0.33. Revenue for the quarter came in at $143.8 million versus the consensus estimate of $122.58 million. Pegasystems, Inc. sees FY2013 EPS of $1.20, versus the consensus of $0.93. Pegasystems, Inc. sees FY2013 revenue of $510 million, versus the consensus of $489 million.

HomeAway (NASDAQ: AWAY) 9% HIGHER; reported Q4 EPS of $0.14, $0.01 better than the analyst estimate of $0.13. Revenue for the quarter came in at $71.6 million versus the consensus estimate of $70.87 million. HomeAway sees FY2013 revenue of $78-79 million, versus the consensus of $77.4 million. HomeAway sees FY2013 revenue of $339-343 million, versus the consensus of $337.3 million.

Tesla Motors, Inc. (NASDAQ: TSLA) 7% LOWER; reported Q4 EPS of ($0.65), $0.12 worse than the analyst estimate of ($0.53). Revenue for the quarter came in at $306 million versus the consensus estimate of $298.9 million. Plans to deliver about 20,000 Model S units in 2013

Walter Energy, Inc. (NYSE: WLT) 6% LOWER; reported Q4 EPS of ($1.13), $0.24 worse than the analyst estimate of ($0.89). Revenue for the quarter came in at $479 million versus the consensus estimate of $511.31 million.

Lifelock (NYSE: LOCK) 5% HIGHER; reported Q4 EPS of $0.10, $0.03 better than the analyst estimate of $0.07. Revenue for the quarter came in at $78.8 million versus the consensus estimate of $73.43 million. Lifelock sees FY2013 EPS of ($0.02)-0.00, versus the consensus of ($0.01). Polypore International (NYSE: PPO) 5% LOWER; reported Q4 EPS of $0.43, $0.10 worse than the analyst estimate of $0.53. Revenue for the quarter came in at $180.2 million versus the consensus estimate of $191.82 million. The Board of Directors has authorized the Company to repurchase up to 4 million shares of common stock by December 31, 2013

Synacor (NASDAQ: SYNC) 5% LOWER; reported Q4 EPS of $0.03, in-line with the analyst estimate of $0.03. Revenue for the quarter came in at $32.2 million versus the consensus estimate of $32.09 million. Synacor sees Q1 2013 revenue of $28.5-29.5 million, versus the consensus of $33.03 million. Synacor sees FY2013 revenue of $122-126 million, versus the consensus of $147.05 million

Abiomed, Inc. (NASDAQ: ABMD) 5% HIGHER; received a 'Close-Out Letter' from the FDA related to its previous FDA warning letter dated June 10, 2011. The close-out letter states that the FDA Office of Compliance has completed its evaluation of the corrective actions taken by Abiomed in response to the previously disclosed FDA warning letter and that the concerns cited in that letter appear to have been addressed.

IMAX Corp. (NYSE: IMAX) 4% HIGHER; reported Q4 EPS of $0.23, $0.07 better than the analyst estimate of $0.16. Revenue for the quarter came in at $77.8 million versus the consensus estimate of $74 million.

Synopsys, Inc. (NASDAQ: SNPS) 4% HIGHER; reported Q1 EPS of $0.67, $0.17 better than the analyst estimate of $0.50. Revenue for the quarter came in at $475.1 million versus the consensus estimate of $473.12 million. Synopsys, Inc. sees Q2 2013 EPS of $0.63-0.65, versus the consensus of $0.55. Synopsys, Inc. sees Q2 2013 revenue of $490-500 million, versus the consensus of $486.10 million. Synopsys, Inc. sees FY2013 EPS of $2.35-2.40, versus the consensus of $2.28.
