Netlist Inc. (Nasdaq: NLST) 23% LOWER; Inphi Corporation has filed a patent infringement lawsuit against Netlist in the United States District Court for the Central District of California. Inphi's lawsuit alleges that Netlist's DDR3 Registered memory modules, including their recently announced HyperCloud(TM), infringe on the following Inphi U.S. Patents: No: 7,307,863 and 7,479,799. The patents relate to memory interface technologies used in enterprise server and storage applications.
Cutera, Inc. (NASDAQ: CUTR) 13.3% LOWER; announced today that it is postponing indefinitely the release of its TruSculpt body contouring product. Click here for the full report.
Linktone (NASDAQ: LTON) 9.3% LOWER; reports Q3 adj-EPS of $0.01, compared to $0.02 in the same quarter last year. Revenue for the quarter was $17.6 million, versus $16.59 million in Q308.
Omnivision Technologies (NASDAQ: OVTI) 9.3% LOWER; reports Q2 EPS of $0.27, ex-items, 11 cents better than the analyst estimate of $0.16. Revenue for the quarter was $183.3 million, which compares to the estimate of $163.74 million. Sees Q3 sales of $145-$160 million and adj-EPS of $0.14-$0.24.
Guess? Inc. (NYSE: GES) 8% HIGHER; reports Q3 EPS of $0.69, versus the analyst estimate of $0.51. Revenue for the quarter was $522.8 million, which compares to the estimate of $482.57 million. Comps down 3.4%. Sees Q4 EPS of $0.77-$0.80, versus the consensus of $0.69. Sales are expected to be $585-$605 million, versus the consensus of $563.79 million.
SandRidge Energy, Inc. (NYSE: SD) 6% LOWER; today announced that it is selling shares of its preferred and common stock in connection with the planned acquisition of oil and gas properties in the Permian Basin from Forest Oil Corporation (NYSE: FST). The company has entered into an agreement to issue and sell 2,000,000 shares of its 6.0% convertible perpetual preferred stock to an institutional investor for an aggregate purchase price of $200 million. The company also announced today a registered underwritten public offering of 22,000,000 shares of its common stock.
Vanguard Natural Resources, LLC (NYSE: VNR) 4.9% LOWER; today announced that it has commenced a public offering of 2,250,00 common units representing limited liability company interests in the Company pursuant to an effective shelf registration statement on Form S-3 filed with the Securities and Exchange Commission. The Company has granted the underwriters a 30-day option to purchase up to an additional 337,500 common units. The Company intends to use the net proceeds from the offering to redeem 250,000 common units from one of its unitholders, Nami Capital Partners, LLC, and to repay indebtedness outstanding under its reserve-based credit facility.
Altera Corporation (NASDAQ: ALTR) 3.7% HIGHER; now expects sales for Q4 to be 15-18% above Q3 levels. Previous guidance was for sales growth of 6-10%.
Human Genome Sciences, Inc. (Nasdaq: HGSI) 3.7% LOWER; has commenced an underwritten public offering of up to 12,500,000 shares of its common stock. The Company intends to grant the underwriters a 30-day option to purchase up to an additional 1,875,000 shares of the Company’s common stock.
