Newland & Newland File Food Poisoning Complaint Stemming from Alleged Salmonella Outbreak at Funeral Luncheon

According to court documents, on Saturday, July 18, 2015, Greg Smith, operating under the name of Family Affair Catering, manufactured and provided catering services for a funeral ceremony at the McHenry Moose Lodge. The court documents also state, on or about the week of July 22, the McHenry County Health Department learned of a potential outbreak of Salmonella illnesses at the aforementioned ceremony, linked to food manufactured and provided by Smith.

"Court documents further allege that Smith was operating without proper licensing to do so," said attorney for the plaintiffs, Gary Newland. "According to court documents, a McHenry County Health Department report states this mass food poisoning included at least sixteen identified Salmonella cases, including the plaintiffs, Adams and Winandy."

Court documents further explain that both Adams and Winandy allegedly told the defendant at the ceremony that the food he provided appeared undercooked and raw. The court documents also state that both plaintiffs later suffered from alleged severe gastrointestinal symptoms, including nausea, vomiting, stomach cramps and general malice. Adams was seven months pregnant at the time and on July 24, Winandy visited the emergency room due to his deteriorating condition, undergoing various forms of treatment.

Both plaintiffs, according to court documents, were informed that they tested positive for Salmonella. The complaint filed by Newland on behalf of the plaintiffs claims that the defendant is strictly liable for the harm allegedly caused by his manufacture and distribution of an alleged unsafe food product.
