Missouri Supreme Court Affirms City of St. Louis Venue for GM Ignition Switch Cases

JEFFERSON CITY, Mo., Jan. 27, 2016 /PRNewswire/ -- The Supreme Court of Missouri ruled yesterday in favor of vehicle owners who are suing General Motors Co. (NYSE: GM) over an ignition switch defect that led to at least 169 deaths and forced GM to recall millions of cars. The consolidated lawsuits involving hundreds of victims will now proceed in the Circuit Court of the City of St. Louis despite GM's attempts to have the claims separated and reassigned to other courts.

"I have said from day one that City of St. Louis is the proper venue and that these claims should be together. GM appealed the cases to the Missouri Supreme Court after the trial court designated the City of St. Louis as the proper venue and ordered the different claims to be grouped as a single joint action. The lawsuits are based on separate crashes involving 12 different GM models and model years, including Buick, Cadillac, Chevrolet, Pontiac and Saturn models. The ruling was issued January 26, 2016.

"GM wanted it both ways by previously arguing for cases to be joined and tried together in New York federal court, but the company took the exact opposite stance in Missouri," says Mr. Potts. "Now, my clients and I are getting ready for trial so a jury can decide whether GM should be held responsible for building and selling cars with these unreasonably dangerous defects."
