Boston Scientific Transvaginal Mesh Lawsuit Trial Ends With $100 Million Verdict

Boston Scientific Corp. has been ordered to pay $100 million in punitive and compensatory damages to a transvaginal mesh lawsuit (http://www.vaginalmeshlawsuit2015.com/) plaintiff who suffered serious complications following implantation of the company's Pinnacle and Advantage Fit devices. According to a verdict rendered on May 28th in Delaware Superior Court, the plaintiff was awarded $25 million in compensatory damages after the jury found that the implants were defectively designed, and that Boston Scientific concealed their flaws. The jury also assessed Boston Scientific $75 million in punitive damages after determining that the company had engaged in fraud by failing to warn doctors about the devices' faulty design. Transvaginal Mesh Litigation

Court documents indicate that the Delaware verdict is the largest so far involving Boston Scientific's vaginal mesh products. Two federal bellwether trials that were convened last year concluded with favorable decisions for plaintiffs. On November 20, 2014, a jury hearing arguments in U.S. District Court, Southern District of West Virginia, awarded a total of $18.5 million, including $4 million in punitive damages, to four women who were injured by the Obtryx implant. (Case No. No. 12-cv-8633) A week earlier, a jury empaneled in the U.S. District Court, Middle District of Florida, to hear a case involving Boston Scientific's Pinnacle Pelvic Floor Repair Kit awarded more than $26 million to four women who were injured by that device. (Case No. 2:13-7965)

Last September, a jury in Texas's Dallas District Court ordered the company to pay $73 million in punitive and compensatory damages to another Obtryx mesh victim. However, court records show that punitive damages were later reduced in the case to comply with Texas law, reducing the total judgment to $34 million. (Case No. DC-1214349)

According to court documents, Boston Scientific has prevailed in two vaginal mesh trials, both of which where heard last summer in Massachusetts's Middlesex Superior Court. (Case Nos. No. 12-0909 and MICV2012-02912)

"It's striking that three of the four juries which returned favorable rulings for plaintiffs chose to asses significant punitive damages. Such damages are only awarded when a jury determines that a defendant engaged in willful misconduct," says Sandy A. Liebhard.
