UPDATE: Macy's (M) didn't show Martha Stewart (MSO) broke contract terms- Judge

Macy's (NYSE: M) didn't show Martha Stewart Omnimedia (NYSE: MSO) broke contract terms, according to the judge in the case.

UPDATE - New York State Supreme Court Justice Jeffrey K. Oing ruled that Martha Stewart Living didn't violate confidentiality terms of its contract with Macy's in disclosing it to JCPenney (NYSE: JCP).

JCPenney is also being sued by Macy's for carrying MS products.

Earlier in the week, Macy's put up an argument that JCPenney sold Martha Stewart goods in "exclusive categories." The retailer's lawyer Ted Grossman told Oing today the JCPenney was selling some products on its website which were in categories exclusive to Macy's under "Martha Stewart Celebrations."

JCPenney is lower in late trading, while Macy's is up.
