Microsoft (Nasdaq: MSFT) shares are higher amid reports that Google's (Nasdaq: GOOG) Motorola Mobility might be dropping certain claims against the company.
Reports out Wednesday have Motorola withdrawing standard-essential patent claims against Microsoft's Xbox gaming console. The claims were made with the U.S. International Trade Commission (ITC).
The two patents were in relation to the H.264 standard. There will be one more patent subject of investigation following the dismissal.
Microsoft produced documents that Google's claims will have to be withdrawn under FRAND (fair, reasonable and non-discriminatory) terms and offer FRAND licensing to any company who would like to license the patents.
Shares of Microsoft are positive in early trading.
