September 5, 2014 7:52 AM EDT

Digital Ally (NASDAQ: DGLY) is holding overnight gains despite reports it was left out of yet another key police force body cam pilot program.

Overnight it was reported that Washington DC police will roll-out a test of its police body cams program with equipment purchased from three companies: Seattle-based VIEVU LLC, Los Angeles-based Wolfcom Enterprises and Scottsdale, Arizona-based TASER.

Digital Ally was also left out of the more important NYPD pilot program. The nation's largest police force will be testing equipment from VIEVU and TASER.

With shares of Digital Ally up 626% since Ferguson and promises from the CEO that inquiries are up "fivefold," the company needs to start delivering on some key pilot programs.

Shares of DGLY last traded at $26.50, up 1.6% from the close.
