Apple (AAPL) Takes Aim at Google (GOOG) in New U.S. Patent Infringement Case

Aiming to seek justice and limit unnecessary competition, Apple (Nasdaq: AAPL) is seeking a preliminary injunction against Samsung's Galaxy Nexus smartphone in the U.S., FOSS Patents noted. Apple is leveraging four patents on the move.

The key item about Samsung's Galaxy is that it represents the use of Google's (Nasdaq: GOOG) Android 4.0 operating system, the first device to do so in the U.S.

This case is also the first time Apple has filed for both preliminary injunction as well as patent infringement. In past cases, Apple filed the case first and preliminary injunction second, giving Samsung cause to say Apple wasn't urgent about its cause.

Patents Apple claims are being infringed are:
  • U.S. Patent No. 5,946,647 "System and Method for Performing an Action on a Structure in Computer-Generated Data.";
  • U.S. Patent No. 8,086,604 "Universal Interface for Retrieval of Information in a Computer System";
  • U.S. Patent No. 8,046,721 "Unlocking a Device by Performing Gestures on an Unlock Image"; and
  • U.S. Patent No. 8,074,172 "Method, System, and Graphical User Interface for Providing Word Recommendations,"
Android 4.0 is the first update since 3.0 Honeycomb was released last year. This will be the first OS where Google is using a stock install, instead of OEMs like HTC, Samsung, or Motorola Mobility (NYSE: MMI) installing several layers of vendor-specific items before launching devices.
