Madoff's Lawyer Asks For Less-Than-Life, Says Madoff Will Speak Of His Shame

June 23, 2009 11:54 AM EDT

Lawyers for fraudster Bernard Madoff submitted a letter to the judge in the case pleading a lenient sentencing for the self-confessed ponzi-schemer.

Specifically, Madoff's lawyers want him to be given a period of incarnation below a life sentence.

The lawyer said Madoff himself will speak to the "shame he has felt and to the pain he has caused" victims.

Madoff's lawyer said "Thankfully, none of the fury expressed in the victim statements has been as shocking as the death threats and anti-Semitic emails that have been directed toward Mr. Madoff and his counsel."

The lawyer asked the court to disregard the "mob vengeance" desire against Madoff, saying the court should set aside the emotion and hysteria attendant to this case.

The lawyer said Madoff has been cooperative with authorities and therefore advocates that he be given a prison term of 12 years, one year short of this approximate life expectancy of 13 years.

Mr Madoff feels remorse for a crime that he has been involved with for over 20 years. I think not. He has not been co-operative and tried to mail out millions of dollars worth of assets after admitting to the crime. He should have thought about before. Sorry but the pity you seek disappeared with the assets of the people you robbed.
