Marathon Patent Group (MARA) Unit Asserts Patent Rights on EP '611 in France, Italy

Marathon Patent Group, Inc. (Nasdaq: MARA) announced that its wholly-owned subsidiary TLI Communications GmbH ("TLI") has asserted its patent rights related to the French and Italian Parts of European Patent 0 814 611 B1 ("EP '611") in both France and Italy, respectively.

France TLI filed a patent infringement action before the Paris High Court in France against Yahoo! Inc., Yahoo! EMEA Ltd., Yahoo! France SAS and Yahoo! France Holdings SAS (collectively, "Yahoo! France"). TLI is asserting infringement of the French part of EP '611 by Yahoo! France's Internet service, "Flickr," as well as the associated application software for smartphones and tablet computers.

TLI also filed a patent infringement action before the Paris High Court in France against Tumblr Inc., Yahoo! Inc., Yahoo! France SAS and Yahoo! France Holdings SAS (collectively, "Tumblr France"). TLI is asserting infringement of the French part of EP '611 by Tumblr France's Internet service, "Tumblr," as well as the associated application software for smartphones and tablet computers.

Additionally, TLI filed a patent infringement action before the Paris High Court in France against Pinterest, Inc. and Pinterest France SAS (collectively, "Pinterest France"). TLI is asserting infringement of the French part of EP '611 by Pinterest France's Internet service, "Pinterest," as well as the associated application software for smartphones and tablet computers.

Italy TLI filed a request for preliminary injunction before the Court of Milan in Italy against Yahoo! Inc. and Yahoo! EMEA Ltd. TLI is asserting infringement of the Italian Part of EP '611 by Yahoo! Inc. and Yahoo! EMEA Ltd.'s Internet service, "Flickr," as well as the associated application software for smartphones and tablet computers.

TLI is asserting infringement of the Italian Part of EP '611 by Pinterest Inc.'s Internet service, "Pinterest," as well as the associated application software for smartphones and tablet computers.

Germany On May 30, 2016, TLI Communications GmbH enforced a German injunction against Yahoo! Inc. and Yahoo! EMEA Ltd.

The enforcement of the German injunction follows two favorable first instance patent infringement rulings issued April 21, 2016, involving the German part of EP '611 before the Munich District Court I, concerning the Internet service "Flickr" operated by Yahoo! Inc. and Yahoo! EMEA Ltd., as well as the associated application software for smartphones and tablet computers.

The judgment ordered Yahoo! Inc. and Yahoo! EMEA Ltd., to cease and desist from offering and supplying in the Federal Republic of Germany, server resources and/or operating software for smartphones and tablet computers that practice system claim 1 or method claim 15 of EP '611 (as amended). The judgments also included a declaration of liability for damages, as well as a rendering of accounts related to the infringing products. Yahoo! Inc. and Yahoo! EMEA Ltd. have appealed the Munich District Court's judgments.
