Energizer Holdings, Inc., (NYSE: ENR), dismissed its patent infringement claims against Spectrum Brands (NYSE: SPC) after reaching a settlement with Spectrum late last week. The settlement followed the issuance of a preliminary injunction on October 31st. The injunction required Spectrum to withdraw its Rayovac Lithium product from the market and refrain from further sales.
Energizer sued Spectrum immediately after the launch of its primary lithium battery, alleging that Spectrum Brands infringed Energizer's US Patents 5,290,414 and 6,849,360. Energizer was granted the injunction by the United States District Court Western District of Wisconsin. In her opinion, Judge Barbara Crabb opined that Energizer's patents were valid, enforceable and infringed.
"Energizer has spent significant resources over the last 20 years to develop this category leading technology," said Joe McClanathan, President of Energizer Household Products. "Obviously, we were very pleased with the judge's opinion in granting the preliminary injunction, and are equally pleased with the resulting settlement."
